Baker Tilly was retained by outside counsel on behalf of a leading dental implant manufacturer to assist with several matters related to its VA FSS 65IIC contract.
In order to address ongoing pricing and compliance issues under the contract, Baker Tilly examined transactional sales data spanning the most recent five-year contract period and quantified overcharges stemming from unreported price reductions, FSS sales above the negotiated contract prices, sales of products from non-designated countries under the Trade Agreements Act, and the resulting impact to reported sales and Industrial Funding Fee payments. After submitting a mandatory disclosure to address these issues, Baker Tilly supported this client through a verification audit performed by the Office of Inspector General, responding to audit requests and participating in discussions with the OIG alongside the client and counsel. Concurrently, Baker Tilly prepared a new FSS proposal on behalf of the client and provided support during contract negotiations with the VA.
The client was successfully awarded a new VA FSS contract, and reached a mutually agreeable settlement with the government related to the historical issues. Baker Tilly continues to support this client with the development of VA FSS training programs for company executives and sales personnel, as well as in the development of a robust compliance program that will help to prevent future issues under the contract.
